Mitigation of communist crimes cannot be taxed, the Constitutional Court has ruled. Churches will not lose money for stolen property

“This was not an effort to fill the state coffers, but an impermissible reduction in compensation that is supposed to serve to alleviate some of the wrongs committed during the totalitarian era,” said Judge-Rapporteur Jaromír Jirsa. What was stolen should be returned, the Constitutional Court confirmed on Tuesday. It put a stop to the efforts of communist MPs backed by the majority of ANO, ČSSD and SPD’s Tomio Okamura. The court called the taxation of church restitution, which would have earned the state at least CZK 8 billion over the next 23 years, unconstitutional. The court upheld the senators’ motion and struck down the disputed part of the law.
